EL SALTO BOOKINGS LLC

BOOKING TERMS, CONDITIONS, WAIVER & RELEASE

Effective Date: August 1, 2026

These Booking Terms, Conditions, Waiver & Release (“Terms”) govern all reservations, payments, bookings, and related booking services provided by El Salto Bookings LLC (“El Salto Bookings,” “we,” “us,” or “our”) for fishing trips to El Salto Lodge in Mexico.

By submitting a reservation request, paying a deposit or other amount, accepting an invoice, clicking an acceptance checkbox, signing a booking confirmation, or otherwise participating in a trip arranged by El Salto Bookings, the customer (“Customer,” “you,” or “your”) acknowledges that they have read, understood, and agreed to these Terms.

If you do not agree to these Terms, do not submit payment or participate in a trip arranged by El Salto Bookings.


1. EL SALTO BOOKINGS LLC IS A BOOKING AGENT FOR EL SALTO LODGE

El Salto Bookings LLC is a separate Oregon limited liability company that provides booking and reservation services for fishing trips to El Salto Lodge in Mexico.

El Salto Bookings LLC and El Salto Lodge are separate businesses and legal entities. El Salto Bookings LLC is not El Salto Lodge and does not own, operate, manage, supervise, or control El Salto Lodge or its operations in Mexico.

El Salto Bookings’ role is limited primarily to marketing, accepting and processing reservations and payments, communicating booking information, and assisting customers with arrangements for trips to El Salto Lodge.

The actual fishing trip and lodge services are provided in Mexico by El Salto Lodge, including, as applicable:

  • Lodging and accommodations;

  • Fishing activities;

  • Fishing guides;

  • Boats and boat operators;

  • Local transportation;

  • Airport transportation;

  • Drivers;

  • Meals and food services;

  • Fishing equipment made available for rental;

  • Lodge facilities;

  • Local personnel; and

  • Other services specifically included in the Customer’s booking.

El Salto Bookings does not own, operate, maintain, inspect, supervise, or control the lodge, boats, vehicles, equipment, facilities, fishing operations, employees, guides, drivers, or other personnel involved in providing services in Mexico.

The Customer acknowledges that El Salto Bookings and El Salto Lodge are separate businesses, and that El Salto Bookings is acting as a booking intermediary rather than as the operator of the fishing trip or lodge.


2. EL SALTO LODGE IS RESPONSIBLE FOR THE ACTUAL TRIP SERVICES

El Salto Lodge is responsible for the actual provision and operation of the services provided to Customers in Mexico.

This includes responsibility for:

  • Fishing activities and guiding;

  • Boats and watercraft;

  • Boat captains and fishing guides;

  • Lodge accommodations;

  • Meals and food services;

  • Local and airport transportation;

  • Drivers and vehicles;

  • Fishing equipment provided for rental;

  • Safety procedures and operational decisions;

  • Compliance with applicable Mexican laws and regulations;

  • Licenses, permits, insurance, and certifications applicable to its operations;

  • Weather and water-safety decisions;

  • The condition and maintenance of its facilities, boats, vehicles, and equipment; and

  • The acts or omissions of its employees, guides, drivers, contractors, and other personnel.

Any complaint concerning the actual provision of the trip services should be directed to El Salto Lodge. El Salto Bookings may assist the Customer in communicating with El Salto Lodge but does not assume responsibility for the operation or performance of the services provided in Mexico.


3. TRAVEL AND FISHING ARE AT YOUR OWN RISK

You understand that international travel and participation in fishing, boating, outdoor, and recreational activities involve inherent and potentially serious risks.

These risks may include, without limitation:

  • Automobile or other transportation accidents;

  • Boat accidents or collisions;

  • Drowning or near-drowning;

  • Falls;

  • Slips and trips;

  • Serious bodily injury;

  • Disability;

  • Death;

  • Exposure to heat, sun, rain, wind, storms, or extreme temperatures;

  • Rough water and changing lake conditions;

  • Fishing hooks, knives, firearms, or other equipment;

  • Wildlife, insects, reptiles, or other animals;

  • Foodborne illness;

  • Illness or disease;

  • Dehydration or heat-related illness;

  • Theft or loss of personal property;

  • Crime or civil disturbances;

  • Road conditions;

  • Mechanical failures;

  • Equipment failures;

  • Delays, cancellations, or missed transportation;

  • Airline delays or cancellations;

  • Lost luggage;

  • Immigration or customs issues;

  • Passport or documentation problems;

  • Changes in Mexican laws or regulations;

  • Political unrest;

  • Natural disasters;

  • Weather-related cancellations;

  • Acts of God;

  • Acts of terrorism or violence; and

  • Other risks associated with international travel and outdoor recreational activities.

You voluntarily assume all risks associated with your travel to Mexico and your participation in the trip.

You are responsible for determining whether you are physically and medically capable of participating in the activities included in your trip.


4. RELEASE OF EL SALTO BOOKINGS LLC

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and hold harmless El Salto Bookings LLC and its owners, members, managers, employees, agents, representatives, contractors, and affiliates from claims, demands, damages, losses, liabilities, costs, and expenses arising out of or relating to the actual operation or provision of services by El Salto Lodge or other parties in Mexico, including:

  • Travel to, from, or within Mexico;

  • Transportation;

  • Lodging or accommodations;

  • Fishing activities;

  • Boat or watercraft activities;

  • Fishing guides;

  • Drivers;

  • The acts or omissions of El Salto Lodge or its personnel;

  • Injuries, illness, disability, or death;

  • Damage to, loss of, or theft of personal property;

  • Weather or environmental conditions;

  • Equipment failure;

  • Food or beverages supplied by El Salto Lodge;

  • Crime or acts of third parties;

  • Changes in travel conditions;

  • Immigration, customs, passport, visa, or border issues;

  • Government actions or restrictions;

  • Force majeure events; or

  • Any other event occurring during or in connection with the trip.

This release applies whether a claim is based upon contract, negligence, premises liability, strict liability, statute, or another legal theory, to the maximum extent permitted by applicable law.

Nothing in these Terms is intended to waive liability that cannot legally be waived under applicable law.


5. EL SALTO BOOKINGS DOES NOT GUARANTEE FISHING OR TRIP CONDITIONS

El Salto Bookings does not guarantee:

  • A particular number or size of fish;

  • Fishing success;

  • Weather conditions;

  • Lake conditions;

  • Availability of fish;

  • Specific fishing locations;

  • Specific fishing guides;

  • Specific boats;

  • Specific transportation vehicles;

  • Specific rooms or accommodations;

  • Uninterrupted service;

  • Absence of delays;

  • Absence of cancellations; or

  • Any particular outcome from the trip.

Fishing is an unpredictable recreational activity. No representation or guarantee is made regarding the quantity, size, species, or quality of fish that may be caught.

Photographs, fishing reports, descriptions, testimonials, or other information provided on the El Salto Bookings website or in promotional materials are not guarantees of future fishing conditions or results.


6. DEPOSITS ARE NON-REFUNDABLE

ALL DEPOSITS ARE NON-REFUNDABLE.

Once a reservation has been confirmed and a deposit has been paid, the deposit is considered earned and is not refundable due to:

  • Customer cancellation;

  • Customer illness;

  • Customer injury;

  • Change of plans;

  • Travel delays;

  • Missed flights;

  • Lost luggage;

  • Passport or documentation problems;

  • Weather;

  • Personal emergencies;

  • Failure to obtain required travel documents;

  • Fear or concerns regarding travel;

  • Changes in fishing conditions;

  • Failure to catch fish; or

  • Any other reason attributable to the Customer.

A deposit is not refundable merely because the Customer is unable or unwilling to travel.


7. RESERVATION DATE TRANSFERS AND RESCHEDULING

Although deposits are non-refundable, Customers may request that their reservation be transferred to a different available date.

Date transfers:

  • Are subject to availability;

  • Must be requested in advance;

  • Are not guaranteed;

  • May be subject to additional charges;

  • May be subject to changes in lodging, transportation, fishing, or other rates;

  • Do not constitute a refund;

  • May be subject to limitations imposed by El Salto Lodge; and

  • May require payment of any difference in price applicable to the new reservation date.

El Salto Bookings will make reasonable efforts to assist with a requested date transfer but does not guarantee that the requested date will be available.

Any additional amount required because of a date transfer is the Customer’s responsibility.


8. CANCELLATIONS OR CHANGES BY EL SALTO LODGE

If El Salto Lodge cancels, materially changes, or is unable to provide a booked trip or portion of a trip, El Salto Bookings will communicate the information to the Customer and, where appropriate, assist in communicating with El Salto Lodge.

Any refund, credit, rescheduling, replacement service, or other remedy will be determined based upon the circumstances and the applicable policies of El Salto Lodge.

El Salto Bookings does not guarantee that El Salto Lodge will provide a refund or other compensation.

El Salto Bookings is not responsible for reimbursing the Customer from its own funds for services that El Salto Lodge fails to provide.


9. TRAVEL DOCUMENTS AND CUSTOMER RESPONSIBILITIES

The Customer is solely responsible for obtaining and maintaining all documents required for travel, including, as applicable:

  • Valid passport;

  • Immigration documentation;

  • Visas or permits;

  • Identification;

  • Travel insurance;

  • Required vaccinations or health documentation;

  • Customs documentation;

  • Fishing licenses or permits when required; and

  • Any other documentation required by the United States, Mexico, airlines, transportation providers, or El Salto Lodge.

El Salto Bookings is not responsible for a Customer’s inability to travel because of inadequate, expired, lost, stolen, or incorrect documentation.

Customers are responsible for determining and complying with all applicable requirements for entering Mexico and returning to their home country.


10. TRAVEL INSURANCE

TRAVEL INSURANCE IS STRONGLY RECOMMENDED.

Customers should consider obtaining travel insurance that provides appropriate coverage for:

  • Trip cancellation;

  • Trip interruption;

  • Medical expenses;

  • Emergency evacuation;

  • Lost luggage;

  • Travel delays;

  • Accidents;

  • Illness; and

  • Other risks associated with international travel.

El Salto Bookings does not provide travel insurance and is not responsible for determining whether a Customer has adequate insurance coverage.

Customers are responsible for reviewing their insurance policy and confirming that it provides coverage appropriate for international travel, fishing, boating, medical emergencies, evacuation, and trip cancellation.


11. PERSONAL PROPERTY

El Salto Bookings is not responsible for lost, stolen, damaged, or misplaced personal property.

Customers are responsible for securing their own:

  • Passports;

  • Money;

  • Electronics;

  • Fishing equipment;

  • Luggage;

  • Firearms or other permitted property; and

  • Personal belongings.

Customers should use appropriate caution when transporting or storing valuables during the trip.


12. FISHING EQUIPMENT

Customers are responsible for providing their own fishing rods, reels, and tackle unless rental equipment has been specifically requested and arranged.

El Salto Bookings does not automatically provide fishing rods, reels, tackle, or other fishing equipment as part of the booking.

Fishing equipment may be rented through El Salto Lodge for:

$90 per fisherman, per day

The rental includes:

  • One fishing rod;

  • One fishing reel; and

  • One tackle box.

Rental equipment is subject to availability and should be requested in advance.

El Salto Bookings does not guarantee the availability, condition, type, brand, or specific model of rental equipment.

Customers are responsible for reasonable care of rented equipment and may be responsible for loss or damage caused by their acts or omissions, subject to El Salto Lodge’s applicable policies.


13. TIPPING AND GRATUITIES

Tipping and gratuities are not included in the booking price unless specifically stated otherwise in the Customer’s booking confirmation or invoice.

The customary tipping guidelines for trips to El Salto Lodge are:

Fishing Guides

$30 per fishing guide, per day.

Lodge/Service Staff

$30 total per day for lodge/service staff as a group.

This is $30 total per day, not $30 per individual staff member.

Drivers

$20 per driver, per one-way transfer.

For example, a round-trip airport transfer involving the same driver would generally involve a $20 tip for the trip to the lodge and $20 for the return trip.

These amounts are customary guidelines and may be adjusted by the Customer based on the quality of service and the Customer’s personal preference.

El Salto Bookings does not retain or receive any portion of tips paid to El Salto Lodge guides, staff, drivers, or other personnel.


14. MEDICAL CONDITIONS AND EMERGENCIES

Customers are responsible for determining whether they are physically capable of participating in the trip.

Customers should disclose relevant medical conditions, allergies, medications, physical limitations, dietary restrictions, or other circumstances to El Salto Lodge when necessary for safe participation or appropriate care.

In an emergency, the Customer authorizes El Salto Lodge personnel and emergency personnel to obtain or provide emergency medical assistance as reasonably necessary.

All medical, evacuation, transportation, and related expenses are the Customer’s responsibility unless covered by applicable insurance or another responsible party.


15. ALCOHOL AND IMPAIRMENT

Customers are responsible for their own behavior and decisions while traveling and participating in trip activities.

Customers must comply with all applicable laws and reasonable safety instructions provided by El Salto Lodge personnel.

A Customer who becomes impaired by alcohol, drugs, or any other substance may be refused participation in an activity when necessary for safety.

No refund is guaranteed for services refused or missed because of Customer intoxication, impairment, misconduct, or violation of El Salto Lodge rules.

Customers acknowledge that operating or participating in boating and fishing activities while impaired may create significant safety risks.


16. FORCE MAJEURE

El Salto Bookings is not responsible for failure, delay, cancellation, interruption, or modification of booking or trip arrangements resulting from circumstances beyond its reasonable control, including but not limited to:

  • Hurricanes;

  • Tropical storms;

  • Floods;

  • Earthquakes;

  • Fires;

  • Extreme weather;

  • Government restrictions;

  • Border closures;

  • Civil unrest;

  • War;

  • Terrorism;

  • Epidemics or pandemics;

  • Strikes;

  • Transportation disruptions;

  • Mechanical failures;

  • Power outages;

  • Acts of God;

  • Acts of third parties; or

  • Other circumstances beyond El Salto Bookings’ reasonable control.


17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, El Salto Bookings LLC shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to a booking or trip.

To the fullest extent permitted by applicable law, El Salto Bookings’ total liability arising from or relating to a booking shall not exceed the amount of the booking fees actually retained by El Salto Bookings for that particular reservation, except to the extent such limitation is prohibited by applicable law.

This limitation applies regardless of the legal theory asserted.

Nothing in this section limits liability to the extent such limitation is prohibited by applicable law.


18. CUSTOMER INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless El Salto Bookings LLC and its owners, members, managers, employees, agents, representatives, contractors, and affiliates from claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising out of:

  • Your violation of these Terms;

  • Your violation of applicable laws;

  • Your negligent or intentional conduct;

  • Your misconduct;

  • Your violation of El Salto Lodge rules;

  • Damage caused by you to persons or property; or

  • Claims arising from your actions or omissions during the trip.


19. SEPARATE BUSINESSES

The Customer acknowledges and agrees that El Salto Bookings LLC and El Salto Lodge are separate businesses and legal entities.

El Salto Bookings LLC is not an owner, operator, employee, agent, partner, joint venturer, or representative of El Salto Lodge unless expressly stated otherwise in a separate written agreement.

Likewise, El Salto Lodge is not an employee, agent, partner, joint venturer, or representative of El Salto Bookings LLC.

The booking of a trip through El Salto Bookings does not merge the businesses or make either business responsible for the independent operations of the other.

El Salto Bookings’ role is to arrange and facilitate reservations for trips to El Salto Lodge.


20. WEBSITE INFORMATION AND REPRESENTATIONS

El Salto Bookings makes reasonable efforts to provide accurate information but does not warrant that all website content, photographs, descriptions, pricing, schedules, availability, fishing reports, or other information is complete, current, or error-free.

Photographs and descriptions may be illustrative and may not represent the exact conditions, accommodations, boats, equipment, fishing locations, fish availability, or services provided during a particular trip.

Information concerning fishing conditions or prior catches is provided for informational and promotional purposes and does not constitute a guarantee of future fishing success.


21. PAYMENT AUTHORIZATION AND CHARGEBACKS

By submitting payment, the Customer authorizes El Salto Bookings to process the payment for the reservation and agrees that the payment is subject to these Terms.

Customers agree not to initiate a fraudulent or improper chargeback in an attempt to circumvent the applicable cancellation, deposit, or refund policy.

A legitimate billing dispute should first be brought to El Salto Bookings so that the parties may attempt to resolve the matter.

Nothing in this section limits any rights the Customer may have under applicable law or the rules applicable to the Customer’s payment method.


22. ACCURACY OF CUSTOMER INFORMATION

The Customer is responsible for providing accurate information, including:

  • Full legal name;

  • Contact information;

  • Travel dates;

  • Number of travelers;

  • Passport or travel information when required;

  • Special requests;

  • Medical or dietary information when relevant; and

  • Any other information necessary to arrange the reservation.

El Salto Bookings is not responsible for problems caused by inaccurate or incomplete information supplied by the Customer.


23. CHANGES TO RESERVATIONS

Changes requested by the Customer may result in additional fees or charges.

Changes may also affect:

  • Availability;

  • Lodging;

  • Fishing arrangements;

  • Transportation;

  • Equipment;

  • Pricing; or

  • Other services included in the original reservation.

El Salto Bookings will communicate known additional charges to the Customer before processing requested changes when reasonably possible.


24. GOVERNING LAW AND VENUE

These Terms shall be governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the fullest extent permitted by law, any legal action arising out of or relating to these Terms or the booking services provided by El Salto Bookings shall be brought in a state or federal court located in Oregon.

Nothing in this section is intended to deprive a Customer of rights or remedies that cannot legally be waived or restricted.


25. DISPUTE RESOLUTION

Before filing a lawsuit, the Customer agrees to contact El Salto Bookings and provide a reasonable opportunity to investigate and attempt to resolve the dispute.

The Customer should provide a written description of the dispute and reasonable supporting information so that El Salto Bookings can review the matter.

Nothing in this section prevents either party from seeking emergency injunctive or other relief when permitted by law.


26. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.


27. NO WAIVER

El Salto Bookings’ failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.


28. ENTIRE AGREEMENT

These Terms, together with the applicable invoice, booking confirmation, and any written agreement expressly incorporated into the reservation, constitute the agreement between the Customer and El Salto Bookings concerning the booking services provided by El Salto Bookings.

Any modification must be made in writing by El Salto Bookings.

If there is a conflict between these Terms and a specific written booking confirmation, the specific booking confirmation will control only with respect to the specific reservation terms expressly stated in that confirmation.


29. ACKNOWLEDGMENT AND ACCEPTANCE

By submitting a payment or reservation, the Customer confirms:

I HAVE READ THESE TERMS AND CONDITIONS. I UNDERSTAND THAT EL SALTO BOOKINGS LLC IS A SEPARATE OREGON BOOKING COMPANY THAT ARRANGES FISHING TRIPS TO EL SALTO LODGE IN MEXICO. I UNDERSTAND THAT EL SALTO BOOKINGS LLC IS NOT EL SALTO LODGE AND DOES NOT OWN, OPERATE, MANAGE, OR CONTROL THE LODGE, FISHING, BOATS, GUIDES, TRANSPORTATION, MEALS, EQUIPMENT, OR OTHER SERVICES PROVIDED IN MEXICO.

I UNDERSTAND THAT TRAVEL TO MEXICO AND FISHING, BOATING, AND OUTDOOR ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING SERIOUS INJURY, ILLNESS, AND DEATH. I VOLUNTARILY ACCEPT THESE RISKS AND AGREE TO THE RELEASE, WAIVER, LIMITATION OF LIABILITY, INDEMNIFICATION, PAYMENT, AND CANCELLATION TERMS CONTAINED HEREIN.

I UNDERSTAND THAT ALL DEPOSITS ARE NON-REFUNDABLE, BUT THAT RESERVATION DATES MAY BE TRANSFERRED SUBJECT TO AVAILABILITY AND THE CONDITIONS STATED ABOVE.

I UNDERSTAND THAT FISHING RODS, REELS, AND TACKLE ARE NOT INCLUDED UNLESS SPECIFICALLY STATED IN MY BOOKING. I UNDERSTAND THAT RENTAL FISHING EQUIPMENT MAY BE AVAILABLE FOR $90 PER FISHERMAN, PER DAY, INCLUDING A ROD, REEL, AND TACKLE BOX.

I UNDERSTAND THAT TIPPING IS NOT INCLUDED IN MY BOOKING PRICE UNLESS SPECIFICALLY STATED OTHERWISE, AND THAT THE CUSTOMARY TIPPING GUIDELINES ARE $30 PER GUIDE PER DAY, $30 TOTAL PER DAY FOR LODGE/SERVICE STAFF AS A GROUP, AND $20 PER DRIVER PER ONE-WAY TRANSFER.

BY SUBMITTING PAYMENT OR OTHERWISE ACCEPTING MY RESERVATION, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS AND CONDITIONS.
